Millman's Pension Problem

Crain's NY -- Assemblywoman Joan Millman, D-Brooklyn, says she erred in a debate last week against challenger Doug Biviano when she said that she could not defer her teacher's pension while she works in the Assembly. She can, but she won't, because she does not consider getting paid as an Assemblywoman while also receiving her city teacher's pension to be “double-dipping.” She says her pension over the past several years has ranged from $48,000 to $52,000. While she is eligible for a pension for her work in the Assembly, she says she won't collect it.

On the tape of the debate Millman says:

“You can’t rescind it (pension) and so I’ve been collecting it.”

If you had (the ability to defer pension) would you have deferred it (the pension)?

“If that had been an option, sure. If it had been offered to me at the time...”

Brooklyn Paper Reported Millman lied about not being able to suspend her pension

At that debate, Millman lied when she reported that she could not defer her pension and said she would defer it if she could. The online editions of the Brooklyn Paper and New York Post reported the next day:  “Actually, you can (defer your pension). According to the Teachers Retirement System website, educators can voluntarily suspend their retirement allowance by filing a ‘Retirement Allowance Suspension / Resumption Form.’
